Brdr. Krüger – General Terms & Conditions

These Terms & Conditions apply to all offers, orders, order confirmations, invoices, and deliveries made by Brdr. Krüger A/S, unless otherwise agreed in writing. By placing an order, the customer accepts these Terms in full.

1. Trademarks & Copyright

All Brdr. Krüger product designs, names, images, and written content are protected by international copyright and trademark laws. No content may be copied, reproduced, or used without prior written consent from Brdr. Krüger.

2. Ordering

Orders can be placed:

  1. Online at www.brdr-kruger.com
  2. By email at info@brdr-kruger.dk

To place an order, the customer must be authorised to use the chosen payment method and accept these Terms & Conditions.

Orders are not binding until Brdr. Krüger issues a written Order Confirmation (OC).

3. Order Confirmation

An order becomes legally binding only once the customer has received an official Order Confirmation specifying the products, pricing, lead time, and delivery method.

4. Order Cancellation

  • Cancellation within 0–5 days of the OC: no fee
  • Cancellation after 5 days: 15% fee (excl. VAT)
  • Custom-made or customised items are non-cancellable

For customised products (special finishes, COM/COL, colours, upholstery, etc.), all details must be approved in writing prior to production.

5. Measurements

All product dimensions are approximate.

Natural materials and craftsmanship may result in slight variations in colour, size, grain, and texture.

6. Delivery

Delivery is made according to the method stated in the Order Confirmation.

6.1 Ex Works – B2B Clients

For items sold Ex Works, the customer is responsible for collecting the goods from Brdr. Krüger’s workshop and for arranging all transport, insurance, and related costs.

If the goods are not collected within the agreed period, a storage fee of DKK 20 / EUR 3 per package per day will be charged.

6.2 Delivery Arranged by Brdr. Krüger – B2B Clients

Upon request, Brdr. Krüger can arrange shipment through our trusted freight partners.

All shipments arranged by Brdr. Krüger are sent under DAP Incoterms. Goods are shipped on a pallet unless the item is small enough to be shipped as a parcel. Pallet dimensions are stated on the invoice.

Once the shipment has been dispatched, Brdr. Krüger will confirm shipment and issue the invoice, which also serves as notification that the goods have left our facility. After collection, the freight forwarder will contact the customer directly to coordinate delivery details. The customer will receive a tracking link and delivery updates from the forwarder.

Transit times and delivery arrangements are managed by the freight forwarder and not by Brdr. Krüger. All deliveries are made curbside only. The goods will be left at the curb at the delivery address and will not be carried indoors. Any delivery restrictions or special requirements must be communicated by the customer in advance.

Additional delivery services (e.g. white-glove service, indoor delivery, timed delivery) are subject to availability and additional costs.

6.3 Delivery for Web Orders – B2C Clients

Web orders within Denmark are shipped by courier to the nearest parcel shop associated with the customer’s address. The customer will be notified directly by the courier when the order is ready for pickup.

International web orders are shipped by our freight forwarder and delivered curbside to the delivery address provided by the customer. Delivery does not include indoor carrying, installation, or assembly.

Any applicable customs duties, local taxes, or import fees for international deliveries are the responsibility of the customer.

Estimated delivery times are provided for guidance only and may vary depending on destination and carrier. If delivery cannot be completed due to an incorrect or incomplete address, or if the customer is unavailable, any additional costs incurred will be charged to the customer.

7. Freight & Transport Damage

Upon delivery, please carefully inspect the shipment before signing the delivery receipt.

  • Inspect the packaging for visible damage (e.g. dents, tears, moisture, cuts, damaged pallets).
  • Verify that the number of parcels and/or pallets corresponds with the delivery documents.
  • If any damage or discrepancies are found, either refuse the delivery or sign with reservation.
  • Ask the driver to clearly note the damage on the delivery receipt (e.g. “torn box”, “broken pallet”, “damaged corner”), including date, time, and signature.

Visible Damage

  • All visible damage must be recorded on the delivery documents at the time of delivery and supported by clear photographs.
  • Without proper documentation, freight companies typically refuse to accept damage claims or provide compensation.

Hidden Damage

Any damage that is not visible at the time of delivery must be reported to Brdr. Krüger in writing within 48 hours of receipt, accompanied by photographic documentation of both the product and the packaging. Claims reported after this period may not be accepted by the freight carrier.

Shipments from Reseller to End Customer

Brdr. Krüger does not cover transport damage that occurs after the goods have left our warehouse or during transport arranged by resellers or third parties.

We recommend that goods are forwarded in their original packaging and, where possible, shipped on pallets to minimize the risk of damage.

8. Claims

All claims must be submitted in writing and include the following information:

  1. A clear description of the issue
  2. Overall and detailed photographs of the product and the reported issue
  3. Product identification, including label, order number, invoice number, and/or delivery note

Brdr. Krüger reserves the right to assess all claims before any resolution is offered.

If a claim is accepted, Brdr. Krüger will, at its discretion, either:

  • replace the item, or
  • professionally repair the defect

Where appropriate, a price reduction or financial compensation may be offered as an alternative solution.

If the issue cannot be adequately assessed based on the information and photographs provided, the item may be required to be returned for inspection. In such cases, return shipping costs will be borne by the customer unless otherwise agreed.

Claims will not be accepted for damage or defects resulting from incorrect cleaning, improper use, unsuitable cleaning agents, modifications, or lack of proper maintenance.

Brdr. Krüger does not accept claims for normal wear and tear or natural variations in materials such as wood, leather, and textiles.

9. Retention of Title

Ownership remains with Brdr. Krüger until full payment and all related expenses have been received.

Brdr. Krüger may transfer payment rights to a third party without affecting this term.

10. Terms of Payment

General Payment Terms

Unless otherwise agreed in writing, payment must be made before the goods are shipped.

New customers are required to pay no later than 14 days prior to the expected delivery date. Customer orders must always be paid upon receipt of the Order Confirmation (OC).

Brdr. Krüger reserves the right to require advance payment if:

  • the customer has an outstanding or previously outstanding balance,

  • the customer fails to comply with agreed payment terms.

Standard Payment Terms for B2B Customers

Brdr. Krüger’s standard payment terms are as follows:

  • New customers: payment is due 2 weeks prior to expected delivery.
  • After a new customer has complied with these terms for a minimum of three (3) orders, the payment term may be adjusted to net 14 days, subject to approval.

Exceptions

The following exceptions apply:

  • Custom orders require 100% advance payment upon Order Confirmation or pro forma invoice.
  • Individually negotiated payment terms, agreed in writing, override the standard terms.

Late Payment & Reminders

In the event of late or non-payment, the following procedure applies:

  • The first reminder is issued without charge.
  • The second, third, and fourth reminders are each subject to a fee of DKK 100.
  • The fourth and final reminder will include a formal notice of debt collection.
  • If payment is still not received, the case will be transferred to debt collection.

Outstanding amounts will accrue interest at 1.5% per month, calculated from the due date.

If payment terms are granted on credit and payment obligations are not met, the customer may be transferred to advance payment terms for future orders.

Any incoming payments will first be applied to outstanding balances, including fees and interest.

Secure Payment & Web Orders (B2C)

All web orders are subject to full prepayment at the time of ordering.

Brdr. Krüger does not charge any credit card or online payment fees. Please note that we are unable to charge an amount higher than the one approved by the customer at checkout.

11. VAT, Customs & Import Duties

For deliveries outside the European Union:

  • Danish VAT (25%) is deducted from the invoice.
  • Any applicable local VAT, customs duties, import fees, and clearance costs are the responsibility of the customer.
  • These charges vary by country and cannot be estimated or controlled by Brdr. Krüger.

For deliveries within the European Union:

  • Danish VAT (25%) will be charged unless the customer provides a valid EU VAT number prior to invoicing.
  • If a valid EU VAT number is provided and verified, the invoice will be issued without Danish VAT, in accordance with applicable EU VAT regulations.
  • The customer is responsible for any local VAT reporting or reverse charge obligations in their country.

Customers are responsible for providing correct and complete VAT information at the time of order. Brdr. Krüger cannot deduct VAT retroactively once an invoice has been issued.

Customers are advised to contact local tax or customs authorities to obtain accurate information prior to placing an order. Brdr. Krüger is not responsible for delays, additional costs, or non-delivery resulting from customs procedures, incorrect VAT information, or unpaid duties and taxes.

  • loss of profits
  • operational losses or business interruption
  • loss of goodwill or reputation

Brdr. Krüger’s liability shall apply only in cases of gross negligence or willful misconduct, to the extent permitted by applicable law.

In all cases, Brdr. Krüger’s total liability is limited to the invoiced value of the affected product.

13. Warranty

Brdr. Krüger provides a 2-year warranty from the date of delivery, covering manufacturing and material defects under normal use.

The warranty is valid only when the product is used in accordance with Brdr. Krüger’s care and maintenance guidelines. Full warranty terms are available upon request.

14. Governing Law & Jurisdiction

All agreements, deliveries, and services provided by Brdr. Krüger are governed by Danish law, excluding its conflict-of-law rules.

All invoices issued by Brdr. Krüger are subject to these Terms & Conditions.

Detailed and updated versions of the Terms & Conditions are available upon request or via Brdr. Krüger’s website. In the event of discrepancies, the latest published version shall prevail.

16. Extended Producer Responsibility (EPR / PPWR – Packaging)

Prices exclude costs related to the EU Packaging and Packaging Waste Regulation (PPWR) and extended producer responsibility for packaging. Applicable packaging fees will be invoiced separately once determined (expected during 2026).
